TL;DR
- opencanvas is pre-launch. Right now this site only offers a waitlist — the product is not generally available, and features we describe may change or never ship.
- No auth yet. During early access there is no login. Access is controlled by a non-guessable project URL plus a secret edit key in the query string (
?key=…). Anyone with the URL can view; anyone with the URL and the key can edit. Treat your links and keys like passwords. Do not put confidential, sensitive, or regulated personal data in opencanvas during this phase. Real authentication is coming soon. - Provided "as is". No warranty of availability, fitness, or that it is bug-free or secure. It's a free early-access preview.
- Limited liability. We're not liable except where German law forbids excluding it (intent, gross negligence, injury to life/body/health, essential duties, Product Liability Act).
- Your content stays yours. You own what you create and are responsible for having the rights to it and for its legality.
- German law applies, jurisdiction Berlin — without affecting your mandatory consumer rights.
1. Acceptance of terms
These Terms of Use ("Terms") govern your access to and use of the opencanvas website at getopencanvas.dev and any early-access service made available through it (together, the "Service"). The Service is operated by Björn Schefzyk, an individual based in Berlin, Germany ("we", "us", "our"). By joining the waitlist or otherwise accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. What opencanvas is
opencanvas is a pre-launch product. At present, this site primarily offers a waitlist so that interested people can be notified when the product becomes available. The product itself is not yet generally available.
Because the product is in active development, any features, capabilities, timelines, or descriptions we publish are aspirational and subject to change. We may modify, suspend, delay, or discontinue any part of the Service — or the product as a whole — at any time, and the product may change substantially or never ship. You should not make decisions in reliance on features that are not yet available to you.
3. The waitlist
When you join the waitlist, you provide your email address and consent to receive email from us relating to opencanvas — in particular a notification when the product launches, together with closely related early-access updates. Joining the waitlist creates no obligation on either side: we are not obliged to grant you access, provide any feature, or launch by any particular date, and you are not obliged to use the product.
You can ask to be removed from the waitlist and to have your email deleted at any time, at no cost, by contacting us at the address in section 11. Details of how we handle your data are set out in our Privacy Policy.
4. Access and security — no authentication
This section is important. Please read it carefully.
During early access, the Service uses no authentication and no login. There are no user accounts, passwords, or sign-in. Instead, access to a project is controlled entirely by two secrets:
- A non-guessable project URL. Each project has a long, high-entropy (unguessable) link. Anyone who has this URL can view the project.
- A secret edit key. Making changes additionally requires a secret edit key, passed as a query-string parameter (for example
?key=…). Anyone who has the view URL and the edit key can edit the project.
The practical consequences are:
- Treat your links and edit keys like passwords or other secrets. Anyone you send them to — intentionally or not — gains the corresponding access. Do not post them publicly, and do not share them with anyone who should not have access.
- Do not store confidential, sensitive, or regulated data. During this phase you must not put confidential information, trade secrets, or sensitive/special-category or otherwise regulated personal data into opencanvas.
- Access follows the secret, not your identity. Because there is no login, we cannot distinguish an authorised person from anyone else who happens to hold your URL or key.
This is a deliberate, temporary trade-off for the early-access phase to let us ship and iterate quickly. Proper authentication is planned and coming soon. Until then, the Service is provided without security guarantees for this access model, and you use it on that basis. To the extent permitted by law, we are not responsible for access, viewing, editing, or loss resulting from a URL or edit key becoming known to others.
5. Acceptable use
You agree not to use the Service:
- for any unlawful purpose, or in violation of any applicable law or regulation;
- to upload, store, or distribute content that is illegal, infringing, defamatory, or that violates the rights or privacy of others;
- to attempt to gain access to projects, data, systems, or accounts that are not yours or that you are not authorised to access — including guessing, enumerating, scraping, or brute-forcing project URLs or edit keys;
- to interfere with, disrupt, overload, probe, or attack the Service or its infrastructure, or to circumvent or test its security measures without our prior written permission;
- to introduce malware or otherwise misuse the Service.
We may suspend or restrict access where we reasonably believe these Terms are being breached.
6. Your content and intellectual property
You retain ownership of the content you create, upload, or store using the Service ("Your Content"). We claim no ownership of it.
To operate the Service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, and display Your Content solely to the extent necessary to provide and operate the Service for you. This licence ends when Your Content is deleted, except for residual copies retained for a limited period as part of routine backups or as required by law.
You are solely responsible for Your Content, including for having all necessary rights, licences, and permissions to use it, and for ensuring it is lawful. The opencanvas name, logo, website, and software are our intellectual property or that of our licensors; nothing in these Terms transfers those rights to you.
7. Disclaimer of warranties
The Service is an early-access preview and is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. In particular, we do not warrant that the Service will be available, uninterrupted, timely, secure, or error-free, that defects will be corrected, or that it is fit for any particular purpose. You use the Service at your own risk and are responsible for keeping your own copies of anything important to you.
8. Limitation of liability
Nothing in these Terms limits or excludes our liability where it may not be limited or excluded under German law. In particular, our liability is not limited:
- for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit);
- for injury to life, body, or health;
- under the German Product Liability Act (Produkthaftungsgesetz); or
- to the extent we have assumed a guarantee.
For the slight negligence (leichte Fahrlässigkeit) of us or our agents, we are liable only for breach of an essential contractual duty (Kardinalpflicht) — a duty whose fulfilment is essential to the proper performance of the contract and on whose observance you may routinely rely — and in that case our liability is limited to the foreseeable damage typical for this type of contract. Any further liability for slight negligence is excluded.
Because the Service is provided free of charge during early access, our liability is limited accordingly, and — subject to the mandatory exceptions above — we are not liable for loss, corruption, or unauthorised access to or editing of data, including where it results from the no-authentication access model described in section 4.
9. Changes to the Service and to these Terms
We may change, update, or discontinue the Service at any time, as described in section 2. We may also update these Terms — for example to reflect the introduction of authentication, new features, or changes in law. The current version is always available at this URL with the "Last updated" date shown above. If we make material changes, we will take reasonable steps to inform you (for example by email to waitlist members). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Berlin, to the extent permitted by law. This choice of law and jurisdiction does not deprive you of the protection of mandatory consumer-protection provisions of the law of the country in which you have your habitual residence.
